The Legislature advanced LB 268 from General File to Select File. Senator Schumacher’s priority bill provides for the creation of liens against real estate transferred to family members in favor of the state to recover Medicaid expenses.
It also eliminates using life estate deeds as an estate planning tool to protect your real estate from Medicaid estate recovery.
Select File is the second debating and voting stage. Bills on Select File may be advanced to the next phase, which is Final Reading. Bills on final reading require a simple majority vote before advancing to the governor.
An amendment to the bill was also adopted. The amendment allows the state to bring an action for recovery of nursing home costs paid by Medicaid against the estate of the person who received Medicaid benefits anytime within five years after the death of the recipient.
